Article 50 of the Treaty on European Union Explained

A member state of the European Union is required to notify the EU of their intention to withdraw. This is stipulated in Article 50. The Article further directs the EU to negotiate the withdrawal agreement with state involved. The following is an explanation of the five key points in Article 50.

  1. A Member State has the freedom of leaving the EU depending on the requirements of its constitution
  2. Any Member State planning to withdraw is required to notify the European Council of the intention. The Council then makes negotiations following the laid down guidelines. When an agreement is arrived at, the arrangements for withdrawing are set while keeping in mind the framework of future relationships. Article 218 (3) of the Treaty on Functioning of the European Union directs the kind of agreement made. The Council acts on behalf of the Union and makes a conclusion. The European Parliament gives consent for these actions
  3. Once the withdrawal process starts, the Treaties will no longer be applied to the State in question.
  4. In order to remain in line with 2 and 3, the Council that represents the given Member State will not take part in the EU discussions as well as decisions made.
  5. Given that an already withdrawn State wants to come back to the Union, Article 49 will guide the whole process

As highlighted above, the form of withdrawing is negotiable. This implies that the terms may as well no be favorable to the UK. The Treaties of the Union will stop applying to UK immediately the process of withdrawing starts. The same will happen after two years when no deal is made, unless an extension is made after an unanimous agreement.
