Registering Your Business Name – You have probably spent endless nights thinking about a unique business name for your start-up business, you made it and you have picked a name that lends itself to wordplay and now it is time to have it registered.

When thinking about registering your business name, ASIC or Australian Securities & Investments Commission is the place to go to. Your name must be registered with ASIC unless you are one of the following;

  • An individual and the business name is the individual’s name (e.g. Aly GadElmoula);
  • A registered company and the business name is the company’s name (e.g. XYZ Pty Ltd); or
  • A partnership and the business name consists of all of the partners’ names (e.g. Aly GadElmoula & David Paterson).

But before you go on with registering your business name, you need to make sure of the following;

1- Your proposed business name does not exist and is not similar to a currently registered name.

2- Your proposed business name does not conflict with a registered trade mark, brand or logo.

Registering your business name with ASIC:

Registering your business name as a trade mark:

Your trade mark is used to distinguish your goods and services from others. It also helps you, legally, stop imitators from using your brand.

This is also done through IP Australia, Intellectual Property, at http://www.ipaustralia.gov.au/

Finally, consider the IP protection options that are appropriate to your business needs.

Registering a domain name:

Your online identity is built through registering a domain name.

First, you must be a commercial entity and have either an Australian Company Number (ACN) or Australian Business Number (ABN) in order to use a ‘.com.au’ or ‘.net.au’ domain name.
